Arden Terms of Sale
These Terms of Sale apply to all purchases made from Arden Collective Ltd ("Arden", "we", "our" or "us").
By placing an order, you confirm that you have read and accepted these Terms of Sale together with our End User Licence Agreement (EULA), which forms part of your purchase.
1. Your Purchase
Your Arden purchase includes:

Immediate access to digital download files.

One professionally printed Arden pack delivered by post.

A non-exclusive, non-transferable licence to use Arden for one specified residential property for a period of 12 months from the date of purchase.

Structural design information for the new extension structure only, where included within your purchased Arden package.
-
Email support for clarification of the contents of your purchased Arden pack only.
Arden is a pre-designed architectural product. It is not a bespoke architectural service.
Your order is accepted when payment has been successfully processed and an order confirmation has been issued.
2. What Is Not Included
Unless expressly stated, your purchase does not include:

Bespoke design work.

Design amendments or revisions.
-
Site-specific adaptations.
-
Measured surveys.
-
Planning application preparation or submission.
-
Building Regulations applications or submissions.
-
Structural calculations for alterations to the existing property, including knock-through works.
-
Foundation design or foundation calculations.
-
Property-specific Part L compliance calculations (including SAP calculations).
-
Site-specific structural engineering advice.
-
Contractor or builder coordination.
-
Site visits.
-
Project management.
-
Architectural consultancy.
Email support is limited to clarification of the information contained within your Arden pack. It does not include project-specific design advice, technical consultancy or professional advice.
3. Delivery
Digital files are supplied immediately following successful payment.
Printed packs are normally dispatched within five working days. Delivery times are estimates only and cannot be guaranteed. We are not responsible for delays caused by postal services or circumstances beyond our reasonable control.
4. Refunds
Because your digital files are supplied immediately after purchase, cancellation rights may be limited once digital content has been accessed, in accordance with applicable consumer legislation.
Refunds will only be provided where required by law or where we agree that a refund is appropriate (for example, in the event of a duplicate purchase).
Before purchasing, you should ensure Arden is suitable for your project by reviewing the product information and using our online suitability guidance.
Nothing in these Terms affects your statutory consumer rights.
5. Licence & Intellectual Property
Your purchase grants you a non-exclusive, non-transferable licence to use Arden for one specified residential property only for a period of 12 months from the date of purchase.
All drawings, specifications, calculations, documents, graphics and other materials remain the intellectual property of Arden Collective Ltd.
No ownership of intellectual property is transferred through your purchase.
Your use of Arden is subject to the terms of the End User Licence Agreement (EULA).
6. Suitability & Purchaser Responsibilities
Before purchasing and before commencing construction, you are responsible for confirming that Arden is suitable for your property.
This includes verifying, where applicable:

Site dimensions and measurements.

Existing structural conditions.
-
Ground conditions and foundation requirements.
-
Planning constraints.
-
Permitted development rights.
-
Conservation Area restrictions.
-
Article 4 Directions.
-
Listed Building status.
-
Building Regulations requirements.
-
Obtaining any property-specific calculations, professional advice or statutory approvals required for your project.
Where necessary, you should seek independent professional advice.
7. Cost Information
Any cost plan, construction estimate or budget information supplied with Arden is provided for general guidance only.
Actual construction costs will vary depending on location, specification, market conditions and contractor pricing.
Additional professional services required for your project, including property-specific structural engineering, foundation design or Part L compliance calculations, are not included within the purchase price.
You should always obtain quotations from suitably qualified contractors before commencing any work.
8. Third-Party Services
Arden may provide introductions or referrals to independent consultants, structural engineers, SAP assessors or other professionals.
Any appointment is made directly between you and the third party.
Arden Collective Ltd accepts no responsibility for the services, advice, fees or performance of any third-party consultant or organisation.
9. Limitation of Liability
Arden is supplied as a pre-designed architectural product intended for use in accordance with its accompanying documentation.
We are not responsible for:

Planning decisions.
-
Building Regulations approval decisions.
-
Construction defects.
-
Builder workmanship.
-
Engineering decisions made by others.
-
Cost overruns.
-
Programme delays.
-
Site-specific conditions.
-
Decisions made by contractors, consultants or suppliers.
Nothing in these Terms excludes or limits any liability which cannot lawfully be excluded under the laws of England and Wales.
10. Professional Appointment
The purchase of Arden does not create an architect–client relationship.
No professional architectural appointment is formed between Arden Collective Ltd and the purchaser.
Arden is supplied as a fixed design product only and is not provided under a RIBA Professional Services Contract or any equivalent professional appointment.
11. Force Majeure
We shall not be liable for any delay or failure to perform our obligations where such delay or failure results from circumstances beyond our reasonable control, including (but not limited to) postal disruption, industrial action, supplier delays, natural events or failures of telecommunications or internet services.
12. Governing Law
These Terms of Sale are governed by the laws of England and Wales.
Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
